Terms of use

Important

Aama is an artificial intelligence program. It is not a human being, not a doctor or therapist, and not an emergency service. Please read sections 2 and 3 carefully before you use the app.

These Terms of Use (the "Terms") are an agreement between you and Surendra Tamang, an individual developer based in Kathmandu, Nepal (the "Developer", "we" or "us") for your use of the Aama application and related services (the "App" or "Aama"). The App includes an AI chat companion and wellbeing tools such as breathing exercises, sounds, a journal and reminders.

1. Acceptance and eligibility

1.1 By downloading, accessing or using the App you confirm that you have read and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the App.

1.2 You must be at least 16 years of age to use the App. By using the App you confirm that you are 16 or older. Persons under 16 must not use the App.

1.3 We do not knowingly collect personal information from persons under 16. If you are a parent or legal guardian and believe that a person under 16 is using the App, please contact us at [email protected].

1.4 If we learn that a person under 16 is using the App, we may suspend or end that person's access without notice and delete any data we hold about them (we do not store chat conversations).

2. What Aama is, and what it is not

2.1 Aama is an artificial intelligence program. The companion in the App is:

  • not a human being;
  • not a doctor, psychologist, psychiatrist, therapist or counselor; and
  • not a licensed professional of any kind.

2.2 Aama does not provide medical, psychological, psychiatric, legal or financial advice, diagnosis, treatment or therapy. The App is not a medical device.

2.3 The companion's persona (for example "Mom") is a fictional character offered for comfort. It has no real feelings, body or presence. It must not be relied on as a substitute for human relationships or for professional care.

2.4 Output generated by artificial intelligence can be wrong, incomplete or inappropriate. You are responsible for how you use it and for any decision you make after reading it.

2.5 The breathing exercises, sounds and other tools in the App are general relaxation features. They are not treatment.

3. Not an emergency service

3.1 Aama cannot call anyone, monitor you, or send help. If you are in danger, or are thinking of harming yourself or others, you must contact your local emergency services or a crisis helpline right away. The App shows helplines by country, and findahelpline.com lists others.

3.2 Crisis detection in the App is automated and imperfect. It may miss or misjudge messages. Aama must not be the only support you use in a crisis.

4. Acceptable use

4.1 You agree not to:

  • use the App for any unlawful purpose;
  • attempt to break, overload, disrupt or abuse the App or its servers, or to bypass usage limits or security measures;
  • use the App to harm, harass or deceive others; or
  • impersonate any person or misrepresent your identity or affiliation.

5. Subscriptions and payments

5.1 Some features are offered through a paid subscription, "Aama Plus". The price and billing period are shown in the App before you purchase.

5.2 Aama Plus is sold through Apple as an in-app purchase. Payment is charged to your Apple ID account at confirmation of purchase.

5.3 Aama Plus includes a 7-day free trial for eligible users. Unless you cancel before the trial ends, it converts to a paid subscription at the price shown.

5.4 The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.

5.5 You can manage or cancel your subscription at any time in your Apple ID account settings after purchase. Deleting the App does not cancel a subscription.

5.6 Payments and refunds are handled by Apple under Apple's policies; we do not process your payment and cannot issue refunds ourselves. Apple's standard terms for apps apply to purchases made in the App; see Apple's Standard End User License Agreement.

6. Privacy

6.1 Our handling of personal information is described in our Privacy Policy.

6.2 You understand that the messages you send to the companion are processed by a third-party artificial intelligence provider in order to produce replies.

7. Disclaimer of warranties

7.1 To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any warranty of accuracy, reliability, availability or fitness for a particular purpose.

7.2 We do not warrant that the App will be uninterrupted or error-free, or that its output, including the companion's replies, will be correct, complete or suitable for you.

8. Limitation of liability

8.1 To the maximum extent permitted by law, the Developer and the Developer's agents, contractors and successors are not liable for any indirect, incidental, special or consequential damages, or for any loss arising from your reliance on output generated by artificial intelligence or from any interruption of the service.

8.2 To the maximum extent permitted by law, the total liability of the Developer and the Developer's agents, contractors and successors to you for all claims arising out of or relating to the App is limited to the amount you paid for the App in the 12 months before the event giving rise to the claim. If you paid nothing, that amount is zero.

8.3 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

9. Your responsibility and acknowledgement

9.1 By using the App you confirm that you understand that Aama is artificial intelligence and not a human being or a professional, that you use it at your own risk, and that you will seek professional help for any medical or mental health need.

10. Indemnity, termination, changes and general terms

10.1 Indemnity. To the extent permitted by law, you agree to indemnify and hold harmless the Developer and the Developer's agents, contractors and successors from claims, losses and reasonable costs arising from your breach of these Terms or your unlawful use of the App.

10.2 Suspension and termination. We may suspend or end your access to the App at any time if you breach these Terms or if we must do so by law. You may stop using the App at any time and may delete your data in Settings. Sections that by their nature should continue after termination will continue.

10.3 Changes to the service. We may change, add or remove features of the App, or stop providing it, at any time.

10.4 Changes to these Terms. We may update these Terms. We will give notice of material changes in the App, and the date at the top shows when they were last updated. If you continue to use the App after a change takes effect, you accept the updated Terms.

10.5 Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions stay in full effect.

10.6 Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and the Developer about the App and replace any earlier understanding on the same subject.

11. Governing law and disputes

11.1 These Terms are governed by the laws of Nepal. The courts of Kathmandu, Nepal have jurisdiction over any dispute arising out of or relating to these Terms or the App.

11.2 If you use the App as a consumer, this section does not take away any mandatory consumer protection rights that you have under the law of the country where you live.
